I've always had great difficulty in thinking about his lack of a trial. It was predictable of the Ministry, but wrong on so many levels. But could he even have been given a fair one? I also rather imagine that he at least had a sentencing which means that, like in your scenario, he would have had to face the people. That makes sense to me. I think it's pretty clear that the Crouch was using this as a political move and, of course, he's make it public.
